General Terms and Conditions

1. Enrolment and payment

As soon as Academia Education AG (hereinafter “Academia”) has received a course enrolment, the course will be confirmed by e-mail or by other means. Course places are allocated in the order of enrolment (subject to the timely payment).

The prices stated at the time of the conclusion of contract apply to the respective services and/or products of Academia. The costs of teaching materials are not included in the course fees, unless explicitly agreed. Academia reserves the right to charge amounts claimed by third parties for travel, entrance fees, meals, accommodation, etc. which are not expressly part of the course.

If a course is fully booked, we try to offer an alternative. Enrolment is binding and obliges the person enrolling for a course to pay the course fee. Non-payment of the course fee shall not be considered cancellation of enrolment. Course fees for at least one month must be paid before the start of the first course. Instalment payments are offered separately at an additional charge. Services booked as private lessons must be taken within two years.

Certain services and/or products of Academia may be subject to separate contractual terms and/or enrolment conditions, which supplement the provisions of these General Terms and Conditions. These may be referred to separately in connection with the respective service/product. Insofar as these separate and special conditions for individual service areas deviate from the provisions of these General Terms and Conditions, the provisions of the special conditions shall take precedence over the respective provisions of these General Terms and Conditions.

2. Implementation

For organisational reasons, Academia reserves the right to postpone or combine courses, change the location of courses, shorten courses with a percentage refund of the course fee or replace the appointed teacher temporarily or permanently with another teacher.

To conduct courses under optimal conditions, Academia defines a minimum and a maximum number of participants for each course offered. As a rule, course fees are not waived or refunded. If the minimum number of participants is not reached, an alternative course shall be offered. If a course falls below the minimum number, Academia reserves the right to hold the course, but to increase the course fee accordingly or to reduce the number of lessons but charge the same price.

Academia reserves the right to exclude course participants from a course on justified grounds (e.g. due to non-payment of the course fee, failure to meet the course requirements, in serious cases such as wilful damage to property, defamation, etc.). In these cases, the entire course fee shall be due, i.e. a proportional amount shall not be refunded nor shall the course fee be waived.

Academia is not liable for the failure to achieve a particular learning outcome, as the participation of course participants and their personal attributes for learning are beyond the control of Academia.

For the courses of Academia that prepare for exams and tests, the participants are responsible for the organisation of and timely registration for the exam as well as payment thereof.

Transfer of course lessons

Course lessons can be transferred to another course location or another course format in special circumstances (e.g. relocation of the customer to another location), provided that Academia offers a corresponding course at the new location. Academia shall decide on the existence of such circumstances and a corresponding course. The request must be submitted in writing to the reception desk responsible at the course location where the student wishes to leave the course. The course must be continued at the new course location within three months, otherwise the entitlement to the lesson credit lapses.

3. Organisation

3.1 Private lessons

The private lesson plan is determined between the participants and Academia.

Cancellation / not taking of lessons

If private lessons cannot be taken or if a person wishes to prematurely terminate such lessons, it is possible to select a substitute participant to take over the services.

Agreed services can be cancelled up to 24 hours before the start of the first agreed lesson for an administrative fee of 30% of the total amount of the agreed service. The date of receipt by Academia shall apply for compliance with the deadline. If the course participant prematurely terminates the agreed course after commencement, Academia shall be entitled to an administrative fee and a cancellation fee of 30% of the residual value of the agreed education programme (i.e. the equivalent of the teaching service not yet received) in addition to the fee for the teaching service already provided at the private lesson rate in accordance with the price list.

All changes to the contract must be made in writing (e-mail or letter).

Cancellation / changing times of lessons

Private lessons can be cancelled or postponed no later than by 16:00 on the previous day (Monday–Friday) by e-mail or telephone during the opening hours of the responsible reception desk. In the event that lessons are cancelled or times are changed later, Academia has the right to charge for the service. Private lessons expire two years after signing the contract, unless otherwise agreed with the school management.

Delay in payment

If one or more instalments are not paid by the agreed payment deadline after the course has commenced, Academia has the right to suspend lessons until payment has been made. The total amount according to the contract continues to be due for payment. Any collection costs shall be borne by the customer.

3.2 Group courses

Cancellation / Non-commencement of the course

If course participants cannot commence the course or if course participants wish to prematurely terminate the course, the customer has the option of selecting a substitute participant who meets the required (minimum) requirements for the corresponding course.

Agreed courses can be cancelled up to one week before the start of the course for an administrative fee of 30% of the total amount of the agreed course. Notice of cancellation must be given in writing by e-mail or letter. The date of receipt by Academia shall apply for compliance with the deadline. Cancellation after this date is no longer possible and course participants owe Academia the full course fee.

Delay in payment

If one or more instalments are not paid by the agreed payment deadline after commencement of the course, Academia has the right to exclude course participants from attendance of the course until all the instalments due have been paid. The course fee shall also be due for the period in which the participant is excluded. Any collection costs shall be borne by the course participants.

Missing lessons / Cancellation of the course

If course participants miss any lessons of the course, they are not entitled to repetition or compensation for missed lessons. This also applies to illness and other hindrances for which Academia is not responsible. Course participants are responsible for catching up on missed work and obtaining relevant material.

4. Course confirmation

Upon request and after at least 80% of the course lessons have been attended, Academia shall issue a course confirmation. This is subject to the condition that the course was attended within the last year. Deviating regulations for certificate and diploma courses are expressly reserved.

5. Insurance

Use of the infrastructure

Course participants attend the course and spend time on the premises of Academia, use the facilities and equipment including computers and monitors and go on any excursions at their own risk.

Course participants are personally liable for any damage caused to premises, facilities, equipment and materials.

Accident / illness / theft and damage

Course participants are responsible for having sufficient insurance coverage. Academia cannot be held liable for theft or the loss of items. Any and all liability for damage incurred is excluded for all courses and events organised by Academia.

6. Complaints

Course participants should always notify the reception desk if they encounter any problems or have any complaints.

7. Data protection

The personal data obtained on the basis of the course contracts will be collected, managed and processed by Academia in accordance with applicable national and supranational legislation. For more detailed information, we refer to our Data Protection Guideline, which is available on our website. If, contrary to expectations, legal disputes should arise in connection with course contracts, Academia reserves the right to transfer the respective personal data to third parties (such as collection agencies and/or courts) in accordance with the law.

Through their enrolment, course participants agree that the data mentioned may be transmitted to other members of the Academia Group, and that this data may be combined with supplementary data held by other members of the Academia Group or which comes from third parties, and used within the entire Academia Group for the analysis of contacts or concluded contracts (customer profiles), and for personalised advertising campaigns.

Video and audio recording: No video or audio recordings may be made anywhere on the premises of Academia without the express permission of Academia, the course participants and staff.

8. Place of jurisdiction

The law of Switzerland applies to all legal relations with Academia. The place of jurisdiction is Zurich, Switzerland.

Should individual or several provisions of the course contract, the general terms of contract or annexes thereto be or become ineffective or invalid, this shall not affect the effectiveness of the rest of the contract. The ineffective or invalid provisions shall be interpreted or replaced in such a way that they most closely approximate the purpose intended with these agreements in a permissible manner. The same shall also apply to any loopholes in the contract.

Agreements between Academia and the contractual partner as well as supplements and amendments must be made in writing in order to be valid.
