General Terms and Conditions

1. Enrolment and payment

Academia Integration or Academia Languages (referred to as “Academia” below) confirms enrolment in a course by e-mail or otherwise upon receipt of enrolment. Course places are allocated in the order of enrolment (subject to timely payment).

Prices provided at the time of conclusion of the contract shall be applicable to the respective services and/or products of Academia.

Costs of teaching materials, excursions, admission fees or food/beverages are not included in the course fee, unless explicitly agreed.

If a course is fully booked, an alternative is offered if possible. Written or oral enrolment is binding and results in an obligation to pay the course fee. Non-payment of the course fee shall not be considered equivalent to cancellation of enrolment. Course fees must be paid before commencement of the course pursuant to the conditions of payment. Payment in instalments may be offered separately subject to an additional charge. Already paid-for private lessons (lesson credit) must be taken within two years.
Additional services and/or products of Academia may be subject to separate contractual terms and/or enrolment conditions, which supplement the provisions of these General Terms and Conditions. These shall be referred to separately in connection with the respective service/product if relevant. Insofar as these separate and special conditions for individual service areas deviate from the stipulations of these General Terms and Conditions, the provisions of the special conditions shall take precedence over the respective provision of these General Terms and Conditions.

2. Conduction

For organisational reasons, Academia reserves the right to postpone, combine or cancel courses, change the location of courses, shorten courses if the number of participants is insufficient or replace the appointed teacher with another teacher temporarily or permanently.

In order to conduct courses under optimal conditions, Academia defines a minimum and maximum number of participants for each course offered. If the minimum number of participants is not reached, an alternative course will be offered. If a course falls below the minimum number, Academia reserves the right to hold the course, but increase the course fee accordingly or reduce the number of lessons while charging the same price. Course fees are generally neither waived nor refunded.

Academia reserves the right to exclude course participants from a course on justified grounds (e.g. due to non-payment of the course fee, failure to meet the course requirements, or in serious cases such as wilful damage to property, defamation etc.). In such cases, the entire course fee shall be owed, i.e. neither will a proportional refund be granted nor shall the course fee be waived.

Academia is not liable for the failure to achieve a particular learning outcome, as the involvement of course participants and their personal requisites for learning are beyond the control of Academia.

As far as Academia courses preparing for exams and tests are concerned, the participants are responsible for organisation of and timely registration for the exam as well as payment thereof.

Fulfilment of technical requirements

Academia provides information about the technical requirements necessary for participation in virtual lessons in a timely fashion. Course participants shall be responsible for ensuring that these are met by the device intended for participation in lessons, including availability of the required internet connection. If lessons cannot be conducted for reasons of non-fulfilment of technical requirements by the course participant, then these must nevertheless be paid.

Login data and passwords

Course participants are obliged to use the assigned personal login data and passwords for accessing the booked virtual services solely for their own purposes and make sure that third parties have no access to these personal data.

Transfer of course lessons

Course lessons can be transferred to another course location or another course format under special circumstances (e.g. relocation of the course participant), provided that Academia offers a corresponding course at the new location. The decision whether such circumstances and a corresponding course exist shall be made by Academia. The request must be submitted in writing to the relevant reception at the course location where the student wishes to leave the course. Group courses must be continued at the new course location within three months, otherwise the entitlement to the lesson credit lapses.

3. Organisation

3.1 Private lessons

“Private lessons” are one-to-one lessons provided by Academia in a traditional classroom or virtual setting (e.g. lessons given by telephone, WhatsApp, Skype or other video conference tools). Individual course schedules are agreed by the participants and Academia.

Cancellation/Non-utilisation of lessons

If private lessons cannot be taken or if a person wishes to stop taking the lessons, a substitute participant can be specified to take over the services.

Agreed services can be cancelled until 48 hours (workdays Monday – Friday) before the first agreed lesson begins. This is subject to an administrative fee of CHF 250. The date of receipt by Academia shall be relevant for determination of compliance with the deadline. If a course participant stops attending the agreed course after this point in time, Academia is entitled to the fee for teaching services already provided (at the rate charged for private lessons specified in the price list), as well as an administrative fee and cancellation fee amounting to 30% of the residual value of the agreed education programme (i.e. equivalent to the value of the teaching service not yet provided).

All changes to the contract must be made in writing (by e-mail or post).

Cancellation/Postponement of lessons

Private lessons can be cancelled or postponed until 16:00 on the workday before the lesson (Monday – Friday) by e-mail or telephone during the opening hours of the relevant reception. If lessons are cancelled or postponed after this point in time, Academia is entitled to charge for the service. Private lessons are forfeited two years after the start of contract. Should a teacher not be available at short notice, Academia will provide a substitute on request and if possible. If a substitute cannot be found in time, Academia reserves the right to cancel the lesson and offer an alternative date.

Late payment

If one or more instalments are not paid by the agreed payment deadline after commencement of service, Academia has the right to suspend lessons until payment has been made. The total agreed sum remains owed. Any collection costs shall be borne by the course participants.

3.2 Private groups

The Terms and Conditions applicable for the product private lessons shall generally also apply for private group bookings. If a member of the private group drops out or cancels, the entire course fee is nonetheless owed in order to continue the group. Cancellation of an ongoing private group credit by an individual member of the group is therefore not possible.

3.3 Group courses (in-person & online courses)

Cancellation/Non-commencement of a course

If course participants cannot commence a course or if course participants wish to terminate a course, the customer has the option to specify a substitute participant who meets the required (minimum) requirements for the particular course.

Agreed courses can be cancelled up to one week before commencement of the course, subject to an administrative fee of 30% of the total amount due for the agreed course. This has to be done in writing (by e-mail or post). The date of receipt by Academia shall be relevant for determination of compliance with the deadline. Cancellation after this point in time is no longer possible and the course participants shall owe Academia the full course fee.

Late payment

If one or more instalments are not paid by the agreed payment deadline after commencement of the course, Academia has the right to exclude course participants from attendance of the course until all the instalments due have been paid. The course fee shall also be due for the period of exclusion. Any collection costs shall be borne by the course participants.

Missed lessons/Cancellation of a course

If course participants fail to attend a course, they cannot request that the missed lessons are made up for or request compensation for the unattended course lessons. This also applies to illness and other hindrances for which Academia is not responsible. Course participants shall be responsible for catching up on missed contents and obtaining relevant material.

4. Course confirmation

On request, Academia can issue a course confirmation after attendance of at least 80% of the course lessons. This only applies to courses attended within the last year. Deviating regulations for certificate and diploma courses are expressly reserved.

5. Examinations

5.1 telc exams

Cancellation up to 2 weeks before the examination date is subject to an administration fee of CHF 100. The entire exam fee will be charged in case of cancellation after this point in time or no-show.

Exams are conducted with adherence to the Terms and Conditions as well as the Examination Regulations of telc GmbH.

5.2 Proof of language proficiency fide

Cancellation up to 2 weeks before the examination date is subject to an administration fee of CHF 100. The entire fee will be charged in case of cancellation after this point in time or no-show.

Exams are conducted in line with the Examination Regulations specified by fide.

5.3 Cantonal German Test for Process of Naturalisation (KDE)

Cancellation conditions are based on agreements with the allocating municipalities of the canton of Zurich.

Exams are conducted in line with the Examination Regulations specified by the canton of Zurich.

6. Insurance

Use of infrastructure

Participants attend the course and spend time on the premises of Academia, use the facilities and equipment including computers and monitors and go on any excursions at their own risk.

Course participants are personally liable for any damage caused to premises, facilities, equipment and materials.

Accident/Illness/Theft/Damages

Course participants are responsible for adequate insurance cover. Academia cannot be held liable for theft or loss of items.
Any and all liability for damage incurred is excluded for all courses and events organised by Academia.

7. Complaints

Course participants are requested to contact the school administration in case of complaints.

8. Miscellaneous provisions

In the event of differences arising due to versions of these Terms and Conditions in various languages, the German version shall be authoritative.

9. Data protection

Personal data obtained on the basis of the course contracts will be collected, managed and processed by Academia in accordance with applicable national and supranational legislation. For more detailed information, please refer to our Data Protection Guideline, which is available on our website. If, contrary to expectations, legal disputes should arise in connection with course contracts, Academia reserves the right to transfer the respective personal data to third parties (such as collection agencies and/or courts) in accordance with the law.

Through their enrolment, course participants agree that the data mentioned may be transmitted to other members of the Academia Group, and that these data may be combined with supplementary data held by other members of the Academia Group or which come from third parties, and used within the entire Academia Group for the analysis of contacts and/or concluded contracts (customer profiles), and for personalised advertising campaigns.

Video and audio recordings: No video or audio recordings may be made without the express permission of Academia as well as the course participants and staff.

10. Place of jurisdiction

The law of Switzerland applies to all legal relations with Academia. The place of jurisdiction is Zurich, Switzerland.

Should individual or several provisions of the course contract, the general terms of contract or annexes thereto be or become invalid or void, this shall not affect the remaining provisions of the contract. The invalid or void provisions shall be interpreted or replaced in such a way that they most closely approximate the purpose intended with these agreements in a permissible manner. The same shall also apply to any loopholes in the contract.

Agreements between Academia and the contractual partner as well as supplements and amendments must be made in writing in order to be valid.
